Harvey Weinstein Hospitalized After New York Court of Appeals Overturns R*pe Conviction

In a surprising turn of events, the New York Court of Appeals overturned Harvey Weinstein’s rape conviction, leading to the former movie mogul’s hospitalization just two days later. The court’s 4-3 ruling stated that improper decisions made during the previous New York County trial prejudiced Weinstein, including allowing women to testify about allegations not part of the initial case.

Following the ruling, Weinstein’s attorney, Arthur Aidala, revealed that his client had been admitted to Bellevue Hospital in Manhattan for a series of tests. “They examined [Weinstein] and sent him to Bellevue,” Aidala said, adding that Weinstein “needs a lot of help, physically” and is “somewhat of a train wreck health-wise.”

Despite his hospitalization, Weinstein remains in custody, according to NYC Department of Correction spokesperson Frank Dwyer. A representative for the former producer expressed gratitude for the care and discretion provided by the NYC DOC in treating Weinstein’s medical issues.

The New York Court of Appeals, the state’s highest court, emphasized the importance of upholding the accused’s rights, regardless of the crime charged or the individual’s reputation. Judge Jenny Rivera wrote in her ruling, “Under our system of justice, the accused has a right to be held to account only for the crime charged and, thus, allegations of prior bad acts may not be admitted against them for the sole purpose of establishing their propensity for criminality.”

The Manhattan District Attorney’s office announced that Weinstein is set to return to court on May 1, although the specific purpose of the hearing was not disclosed. The D.A.’s office reiterated its commitment to retrying the case, stating, “We will do everything in our power to retry [Weinstein’s] case.”

Weinstein’s legal troubles are far from over, as he was also convicted of rape in a Los Angeles trial in December 2022. This means that even if a new trial is established in New York, he will remain in prison and is expected to be transferred to a California facility to begin serving his sentence there.
